The processing of personal data by SmokerShop - FlowCore Srl is subject to European Regulation 2016/679 (the General Data Protection Regulation, GDPR) and to the Belgian law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.
2. What data we collect
Personal data is any information about a person who can be identified. We collect it when you fill it in yourself, when you create an account and order, when you write a review, and automatically when you visit the website.
Data you fill in yourself
To send us a message, call us or sign up for the newsletter, you give us data yourself:
- your name and e-mail address;
- possibly your phone number and your order number;
- the content of your question or message, with the files you attach.
Your account and your orders
You can only order with an account. For this we process:
- your name, e-mail address, delivery and invoice address, and your mobile number (for the carrier);
- for companies: the VAT number;
- your date of birth, and your confirmation at the checkout that you are 18 or older: we may only sell smoking accessories to adults;
- your orders and payments: amount, payment method and payment status.
The payment itself takes place at Mollie or PayPal. We do not see or keep your card number or bank details.
Reviews
If you write a review of a product or of our shop, we keep your rating, your text, the language and the order the review belongs to. With your review we show your first name, the first letter of your last name, the date and your rating. We never show your e-mail address or your order.
Data collected automatically
When you visit, data is collected through cookies and similar techniques, such as:
- your IP address and the time of your visit;
- the pages you view and the website you came from;
- your device, operating system and browser.
We only place cookies that are not necessary with your consent, which we ask through the cookie banner. You can always change that choice. Read more in our cookie policy.
Notifications
If you switch on notifications (in the app, on a sold-out product or after an order), we keep the address your browser creates for them, your language and what you want a notification for: new products, your order leaving or a product coming back in stock. For notifications about your orders we link that address to your account. The notification travels encrypted through your browser's service (Google, Apple, Mozilla or Microsoft): that service cannot read its content. You switch notifications off on the page "Notifications on this device" in your account or in your browser settings. We then delete the address, as we do when your browser no longer accepts it.
No sensitive data
We do not process sensitive data, such as racial or ethnic origin, political opinions, religion or beliefs, sexual orientation, health or trade union membership.
3. Why we use it
We use your data only for the purposes below, each with its legal basis:
- Processing, delivering and following up your order, after-sales service and warranty. Legal basis: performance of the contract.
- Accounting and invoicing. Legal basis: legal obligation.
- The age check when selling smoking accessories. Legal basis: legal obligation.
- Answering your questions. Legal basis: our legitimate interest, or performance of the contract if your question is about an order.
- Asking you by e-mail for a review after a delivery, and showing your review. Legal basis: our legitimate interest. Every review request has a link to stop them.
- The newsletter with new products and news from the shop. Legal basis: your consent. You can unsubscribe at any time through the link in every newsletter.
- Improving the website with statistics. Legal basis: your consent through the cookie banner.
We only collect the data needed for these purposes. Data that is incorrect or incomplete is corrected or deleted.
4. How long we keep it
We do not keep personal data longer than needed for the purpose for which we collected it:
- Orders and invoices: 10 years after the order, as the law requires for accounting and VAT.
- Your account: as long as your account exists. You can always have it deleted; we then keep the data of your orders until the end of the legal period.
- Your reviews: as long as they are online. If your account is deleted at your request, your reviews go with it.
- Customer follow-up and newsletter: up to 3 years after your last order or contact, or until you unsubscribe. They are then deleted.
- Messages through our contact form or by e-mail: up to 2 years after your question was handled.
- Cookies: see our cookie policy.
5. Who we pass it on to
SmokerShop - FlowCore Srl never sells or rents your data. We only pass it on when needed.
To processors working for us
- Mollie and PayPal: payments;
- Sendcloud and DPD, the carrier that delivers your parcel: shipping and tracking your parcel;
- MailerLite: the newsletter;
- our e-mail service: sending e-mails;
- Google: website statistics, only with your consent;
- our hosting provider: the website and the online shop.
A data processing agreement has been signed with every processor. They may only use your data for the task we give them.
Outside the European Union
Some processors are based in the United States. The transfer then takes place on the basis of the EU-US Data Privacy Framework or the standard contractual clauses of the European Commission.
To third parties, when the law requires it
When there is a legal obligation, or at the request of judicial authorities or police services.
6. Your rights
You have the right to:
- see your data;
- have incorrect data corrected;
- have your data deleted, unless the law requires us to keep it;
- have the processing restricted;
- object to the processing, also to direct marketing;
- receive your data in a common format (portability);
- withdraw your consent at any time, without this changing the processing that took place before.
In your account you can also see, change and download your data yourself.
How do you ask? Through our AI assistant on the contact page or by post to SmokerShop - FlowCore Srl, Rue de la Croix Rouge 1, 7740 Pecq, Belgium. We answer within one month. To protect your data we may ask you to confirm who you are.
A complaint? If you are not satisfied with our answer, you can file a complaint with the Data Protection Authority, Rue de la Presse 35, 1000 Brussels, www.dataprotectionauthority.be.
7. Security and changes
We take appropriate technical and organisational measures to protect your data against loss, misuse and access by unauthorised persons. The website uses a secure connection (https), and only staff who need the data for their work can access it.
We may change this privacy policy, for example when the law changes or when we use a new service. The date of the last change is at the top. So check this page from time to time.
